Terms of Service for OctoStats

1. Introduction

Welcome to OctoStats. These Terms of Service ("Terms") govern your access to and use of OctoStats's website and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

OctoStats is a service that allows you to generate and embed GitHub statistics widgets to showcase your GitHub activity. We strive to provide a secure, reliable platform for this purpose.

2. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service, and they have read and agree to these Terms on your behalf.

4. Account Registration and Security

To use our Service, you need to sign in with your GitHub account. You are responsible for:

  • Maintaining the security and confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

5. Description of Service

OctoStats allows you to generate widgets that display your GitHub statistics and activity. Key features include:

  • GitHub activity overview widgets
  • Programming language usage statistics
  • Contribution heatmaps
  • Embedding options for your README, website, or other online profiles

While we strive to ensure accurate representation of your GitHub data, we cannot guarantee perfect accuracy due to factors beyond our control, such as GitHub API limitations, data caching, or connectivity problems.

6. User Data

OctoStats accesses your GitHub data through the GitHub API with your permission. We use this data solely for the purpose of generating statistics and widgets, and to provide and improve our service.

By using OctoStats, you grant us permission to:

  • Access your GitHub profile information
  • Retrieve your repository data and contribution history
  • Store encrypted access tokens to maintain authentication with GitHub
  • Display your GitHub statistics in generated widgets

7. Prohibited Activities

When using our Service, you agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Attempt to decompile, reverse engineer, or disassemble any portion of our Service
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks
  • Use any robot, spider, or other automated device to access the Service
  • Transmit any viruses, malware, or other malicious code
  • Engage in any activity that could disable, overburden, or impair the proper working of the Service

8. Service Limitations and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

We may impose limits on certain features or restrict your access to parts or all of the Service without notice or liability if we believe you are in breach of these Terms or if your use of the Service poses risk to OctoStats, other users, or third parties.

9. Privacy

Our Privacy Policy, available at Privacy Policy, describes how we collect, use, and share information about you when you use our Service. By using the Service, you agree to our collection, use, and sharing of information as described in the Privacy Policy.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by OctoStats and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Service, or our trademarks, logos, or other brand features.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Limitation of Liability

To the maximum extent permitted by law, OctoStats and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available through the Service

13. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. OctoStats expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

OctoStats makes no warranty that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The widgets will display data exactly as expected
  • Any errors in the Service will be corrected

Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your device or loss of data that results from the download of any such material.

14. Indemnification

You agree to defend, indemnify, and hold harmless OctoStats and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

15. Governing Law

These Terms shall be governed by the laws of Slovakia, without regard to its conflict of law principles. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Slovakia.

Nothing in this section will preclude either party from seeking injunctive relief in any jurisdiction to protect its intellectual property rights.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

17. Third-Party Services

Our Service may integrate with or contain links to third-party websites or services that are not owned or controlled by OctoStats. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

These third-party services include:

  • GitHub API and authentication services
  • Google Analytics
  • Microsoft Clarity
  • Supabase for database services

You acknowledge and agree that OctoStats shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OctoStats regarding our Service and supersede all prior agreements and understandings, whether written or oral.
